1. Introduction

Welcome to Firewood Fetch (“we”, “our”, “us”). Firewood Fetch is an online marketplace platform (“the App”) designed to connect buyers and sellers of firewood across Australia. The App allows registered sellers to list firewood products and buyers to browse, order, and arrange delivery or pickup directly through the platform.

By accessing or using Firewood Fetch, you (“you”, “user”) agree to be bound by these Terms and Conditions. If you do not agree, you must not use the App.

2. Use of the App

2.1 Permitted Use

  • Buyers may browse, order, and communicate with sellers through the App.

  • Sellers may create listings, upload photos, manage availability, and accept orders.

  • Both buyers and sellers may rate and review each other, provided the content is truthful, fair, and not misleading.

2.2 Prohibited Use

You agree NOT to:

  • Use the App for illegal or fraudulent activity.

  • Misrepresent your identity, products, or services.

  • Upload offensive, defamatory, or infringing content.

  • Attempt to interfere with the App’s security or functionality.

  • Circumvent fees, dispute processes, or payment systems.

We reserve the right to suspend or terminate any account that breaches these conditions.

3. Subscriptions & Payments

3.1 Sellers

  • Sellers may be required to pay fees to list, boost, or promote their offerings.

  • Fees are subject to change at any time without notice.

  • Payments may be processed via Stripe, PayPal, or Google Pay.

3.2 Buyers

  • Buyers pay sellers directly through the in-app checkout system.

  • Firewood Fetch acts solely as a marketplace facilitator and is not the supplier of the firewood.

3.3 Refunds & Cancellations

  • Buyers must resolve refund and cancellation requests directly with the seller.

  • Firewood Fetch does not guarantee refunds but may intervene at its discretion in cases of fraud or misuse.

4. Seller Responsibilities

Sellers agree to the following:

  • Legality of Wood: Sellers must ensure all firewood is legally sourced and complies with forestry and local regulations. Sellers must confirm legality of supply if requested.

  • Accuracy of Listings: All product descriptions, weights, prices, and images must be truthful and not misleading.

  • Order Fulfilment: Sellers must make reasonable efforts to complete deliveries or pickups in the timeframe agreed with the buyer.

  • Cancellations: If a seller cannot fulfil an order, they must notify the buyer promptly and issue a refund where applicable.

  • Reviews: Sellers may not post false reviews or attempt to manipulate the ratings system.

Failure to comply may result in account suspension or removal from the platform.

5. Intellectual Property

  • All intellectual property relating to the App, including the name Firewood Fetch, logos, design, features, and software, remain the property of Firewood Fetch Pty Ltd.

  • User-generated content (listings, reviews, photos) remains owned by the creator but is licensed to Firewood Fetch on a non-exclusive, royalty-free basis for use within the App (e.g., displaying listings).

  • You may not copy, modify, or distribute our content without permission.


6. Limitations of Liability

  • Firewood Fetch provides a marketplace only and does not guarantee the legality, quality, quantity, or suitability of firewood sold.

  • Sellers are solely responsible for ensuring their firewood is lawfully sourced and accurately represented.

  • Firewood Fetch does not accept liability for disputes, delays, damages, or losses arising from transactions between buyers and sellers.

  • The App is provided “as is” without warranties of any kind, including fitness for a particular purpose or uninterrupted availability.

  • To the fullest extent permitted by law, Firewood Fetch excludes liability for indirect or consequential damages.


7. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Western Australia, Australia.

  • Any disputes shall first be attempted to be resolved informally through our support team.

  • If unresolved, disputes may be referred to the courts of Western Australia.
